1. General and Applicability

These terms govern use of Fluii's mobile application and website, plus all associated services. By creating an account, users accept these terms unconditionally. Fluii may amend these terms anytime; continued use after amendment constitutes acceptance of the new version.

2. The Platform

Fluii operates as a digital intermediary connecting companies ("Clients") who publish creative video challenges with content creators. Clients fund their accounts with money or discount codes. Fluii distributes these amounts monthly directly to Content Creators, depending on the performance achieved (such as views).

3. Registration and Account

Users must create personal accounts to participate. The User warrants that all information provided is accurate, complete and up to date. Users must be at least 16 years old; those under 18 need parental permission. Users remain responsible for account confidentiality.

4. Platform Function and Compensation

Approved creators can participate in assignments. Compensation is based on the number of views the published video achieves. Payouts occur monthly via bank transfer or reward vouchers. Fluii reserves the right to suspend or refuse rewards and payments if there are indications of fraud, abuse, or breach of these Terms. Creators handle their own tax obligations.

5. User Obligations

Content creators must:

  • publish only original, self-created content
  • complete challenges correctly and truthfully
  • respect third-party copyright and portrait rights
  • comply with applicable laws
  • avoid hateful, violent, racist, or pornographic material

6. Liability and Indemnification

Fluii provides the platform 'as is', without any guarantee of availability, performance or freedom from errors. Fluii excludes liability for user content, intellectual property issues, accidents during creation, tax non-compliance, technical problems, and indirect damages. Maximum liability caps at EUR 500 or twelve months of prior payouts. Users must indemnify Fluii against third-party claims.

7. Intellectual Property

Creators retain original content rights unless assignments specify otherwise. By participating in a challenge, the Content Creator automatically grants Fluii and the Client a worldwide, royalty-free, transferable and irrevocable licence for distribution. All platform intellectual property belongs to Fluii.

8. Account Termination

Users may terminate by emailing support. Fluii may suspend or delete accounts for breach of these Terms, fraud, abuse, or harm to other users. The platform may be modified or discontinued anytime without notice or liability.

9. Applicable Law and Jurisdiction

Belgian law governs these terms exclusively. All disputes arising out of or relating to these Terms fall under the exclusive jurisdiction of the courts of the Dutch-speaking district of Brussels. Parties should attempt amicable resolution first.
